Derek Young successfully defended one of the nation’s largest cannabis producer-processor licensees in an administrative enforcement action brought by Washington State’s Liquor and Cannabis Board (“LCB”). The LCB repeatedly cited our client for violations of cannabis-specific advertising prohibitions in the Washington Administrative Code. Ultimately, the Washington Attorney General, on behalf of the LCB, filed a Complaint in which it alleged that our client’s logos and labeling, as well as images posted on social media and websites, constituted “advertising designed in a manner that would be especially appealing to children or other persons under twenty-one years of age.” Mr. Young was hired to concurrently defend the administrative action and design a separate constitutional challenge to the regulations. The matter, which was litigated for over a year, ended shortly after Mr. Young deposed key enforcement staff and the LCB’s designated representative. Mr. Young obtained a dismissal with prejudice of the Complaint in toto. As a result of Mr. Young’s litigation efforts, the LCB commissioned an independent third party to study the regulations challenged by Mr. Young.
Due to his unique knowledge and experience in cannabis-related transactions, including licensing and regulatory actions, Mr. Young has been retained to consult for and represent prospective licensees and investment groups in Washington, Florida, Arkansas, and Ohio.
